DMCA Copyright Policy

1. Overview

LAVT Supply respects the intellectual property rights of others and expects our users to do the same. This policy outlines our compliance with the Digital Millennium Copyright Act ("DMCA") and our procedures for addressing copyright infringement claims.

In accordance with the DMCA and other applicable law, we have adopted a policy of terminating, in appropriate circumstances, accounts of users who are deemed to be repeat infringers.

2. Reporting Copyright Infringement

2.1 DMCA Notice Requirements

If you believe that content hosted on or accessible through the AV Management Suite infringes your copyright, please send a notice of claimed infringement that includes substantially the following:

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
  • Identification of the copyrighted work claimed to have been infringed
  • Identification of the material that is claimed to be infringing and information sufficient to locate the material (e.g., URL, account name, project ID)
  • Your contact information, including your name, address, telephone number, and email address
  • A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner

2.3 What Happens After We Receive a DMCA Notice

Upon receipt of a valid DMCA notice, we will:

  • Acknowledge receipt within 2 business days
  • Review the notice for compliance with DMCA requirements
  • Remove or disable access to the allegedly infringing material
  • Notify the user who posted the material of the removal
  • Take reasonable steps to notify the user of their right to file a counter-notice

3. Filing a Counter-Notice

3.1 Counter-Notice Requirements

If you believe that material you posted was removed or disabled by mistake or misidentification, you may file a counter-notice with our Copyright Agent that includes:

  • Your physical or electronic signature
  • Identification of the material that was removed or disabled and the location where it appeared before removal
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
  • Your name, address, and telephone number
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are outside the United States, for any judicial district in which we may be found)
  • A statement that you will accept service of process from the person who provided the original DMCA notice or an agent of such person

3.2 What Happens After We Receive a Counter-Notice

Upon receipt of a valid counter-notice, we will:

  • Forward a copy of the counter-notice to the original complaining party
  • Inform them that we will restore the removed material in 10-14 business days
  • Restore the material unless the copyright owner files a court action seeking an injunction against the user

4. Repeat Infringer Policy

In accordance with the DMCA and other applicable law, we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, accounts of users who are deemed to be repeat infringers.

We may also, at our sole discretion, limit access to the Service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

5. User Responsibilities

As a user of the AV Management Suite, you are responsible for:

  • Ensuring you have the right to upload and share all content you post to the Service
  • Obtaining necessary permissions, licenses, or releases for copyrighted materials
  • Respecting intellectual property rights of manufacturers, vendors, and other parties
  • Not uploading pirated software, cracked applications, or unauthorized media
  • Complying with copyright laws when sharing documents, images, or other files

6. Specific Scenarios

6.1 Manufacturer Data Sheets and Documentation

When uploading manufacturer data sheets, specification documents, or product images:

  • Ensure you are using publicly available materials provided by manufacturers for distribution
  • Respect manufacturer trademarks and branding guidelines
  • Do not upload materials marked as confidential or proprietary

6.2 Project Documentation

For architectural drawings, CAD files, and project documentation:

  • Ensure you have permission to upload and share these materials
  • Respect copyright of architects, engineers, and designers
  • Obtain client permission before sharing project-specific materials

6.3 Software and Applications

Do not upload or share:

  • Pirated or cracked software
  • License keys or activation codes not owned by you
  • Software in violation of licensing agreements

7. Misrepresentation

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that:

  • Material or activity is infringing, or
  • Material or activity was removed or disabled by mistake or misidentification

...may be subject to liability for damages, including costs and attorneys' fees.

Warning: Do not make false claims. Penalties for misrepresentation can be severe. If you are unsure whether material infringes copyright, consult with a lawyer before filing a notice.

8. Other Intellectual Property

While this policy specifically addresses copyright under the DMCA, we also respect other forms of intellectual property including:

  • Trademarks: Do not use trademarks in a way that causes confusion about source or sponsorship
  • Patents: Respect patent rights when describing or implementing technologies
  • Trade Secrets: Do not upload or share confidential or proprietary information

9. Changes to This Policy

We reserve the right to modify this DMCA policy at any time. Changes will be posted on this page with an updated revision date. Your continued use of the Service after changes indicates acceptance of the updated policy.
